On 6 April 2011 The Competition Act 1998 (Land Agreements
Exclusion Revocation) Order 2010 will take effect. This will mean
that for the first time UK land agreements will be subject to the
full force of the Competition Act. Until this change in the law
certain land agreements have enjoyed the benefit of a specific
exclusion preventing action from being taken under the Competition
Act for restricting competition. This exclusion is now being
revoked and will apply not only to all new land agreements but land
agreements that are already in existence. Types of land agreements
that will be effected include: exclusivity clauses and use
restrictions in leases and title conditions that limit the use of a
property.
