Shropshire directors could face jail if an employee is killed
while driving on company business - even if they're in their own
car.
The stark warning comes from Tony Conlon from Henshalls
Insurance Brokers in Newport and Shrewsbury, who urged company
bosses to take note of new legislation.
"The Corporate Manslaughter Bill means directors must pay close
attention to their responsibilities when it comes to keeping their
staff safe.
"If they fail to protect their employees, or a member of the
public who may be involved in an accident with a company vehicle,
they could personally face a jail sentence or an unlimited
fine.
"And the Bill covers anyone who drives on business for the firm,
including employees who own and drive their own vehicles."
Tony said directors should ensure their insurance policies were
clear and included appropriate cover for such a serious
situation.
"It's important to carry out a risk assessment and look closely
at anyone who drives as part of your business, to check whether
they really do need to be on the road in your name."
But Tony said even though the Bill included such severe
penalties, many people believed the new death by careless driving
offence would have far more wide-reaching consequences.
"Under that act, simply talking or texting on a hand-held mobile
phone at the time of the accident, or driving without proper
insurance could result in a jail sentence for the driver.
"Clearly though, whatever legislation applies, company bosses
need to look closely at their duty of care responsibilities, and
ensure their staff are as safe as possible on the roads."
